• Compatibility information is provided as a guide. It is your responsibility to verify that a part is suitable for your specific vehicle before purchasing.
• We reserve the right to correct any errors in pricing or product information and to cancel orders placed at incorrect prices.

4. Orders and Acceptance

Placing an order on our website constitutes an offer to purchase. An order is not accepted until we send you an order confirmation. We reserve the right to refuse or cancel any order for reasons including:

5. Pricing and Payments

• All prices are listed in Kenya Shillings (KES) and are inclusive of applicable taxes unless stated otherwise.
• We accept payments via M-Pesa, PesaPal (credit/debit cards), and cash on delivery (COD) for eligible orders within Nairobi.
• Payment must be completed before dispatch, except for COD orders where payment is collected upon delivery.
• We reserve the right to change prices at any time. Price changes do not affect orders that have already been confirmed.

6. Shipping and Delivery

• Delivery timelines are estimates and not guarantees. See our Shipping Information page for details.
• Risk of loss passes to you upon delivery. Please inspect all items upon receipt.
• We are not liable for delays caused by courier services, weather, or other circumstances beyond our control.
• You are responsible for providing an accurate delivery address. We are not liable for deliveries to incorrect addresses provided by you.

7. Returns and Refunds

Returns and refunds are subject to our Returns & Exchanges Policy and Refund Policy. Please review these policies before placing an order.

8. Warranties and Disclaimers

• Genuine OEM parts carry the manufacturer's warranty as specified by the manufacturer. Aftermarket parts may carry a separate warranty where applicable.
• We do not warrant that parts will be compatible with your vehicle unless explicitly confirmed by our team in writing.
• Our website and services are provided "as is" without warranties of any kind, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by Kenyan law:

• NiaMotors shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services.
• Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.
• We are not liable for any damages resulting from improper installation or use of purchased parts.

10. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are liable for all activities conducted under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

11. Intellectual Property

All content on this website — including text, images, logos, graphics, and software — is the property of NiaMotors or its licensors and is protected by Kenyan and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

12. Dispute Resolution

In the event of a dispute arising from these Terms or your use of our services:

• If the dispute cannot be resolved informally, it shall be referred to mediation or arbitration in accordance with the Arbitration Act of Kenya.
• These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya shall have exclusive jurisdiction.
